Honeyfund Gift Card Terms and Conditions

1. General Terms

The following terms and conditions govern your use of the Honeyfund.com website ("website") to purchase and/or redeem digital gift cards from Honeyfund registries, Honeyfund Wallet, the Honeyfund Gift Card Shop (shop.honeyfund.com) or the Honeyfund Gift Card (www.honeyfund.com/giftcard) (collectively, "Honeyfund Gift Card Terms" or “Terms”). Your use of the website constitutes your agreement to follow and be bound by the Terms which may be updated or modified at any time without prior notice. For this reason, please review these Terms whenever you use the website. If you do not agree to these terms, please do not use the website. As used herein, the term "we" "us" or "our" means Honeyfund.com, Inc., a Florida corporation ("Honeyfund").

The term "Incomm" refers to Incomm Inc., a Georgia corporation ("Incomm") that provides a platform for purchasing digital gift card codes from Honeyfund. The term “Amazon.com Gift Card” refers to a gift card redeemable only at Amazon.com. The term "you" or "your" means the purchaser and/or recipient of a Honeyfund Gift Card. The term "Partners" means Amazon.com Gift Card or other companies offering gifts cards via the Incomm platform.

2. Gifts purchased via the Honeyfund Gift Card Shop or Honeyfund Registry

eGift Cards purchased via the Honeyfund Gift Card Shop represent an obligation of Honeyfund and are redeemable by recipient on our website via the Amazon.com Gift Card redemption interface or the Incomm platform via APIs.
When you purchase an Honeyfund registry gift or eGift Card via a Honeyfund registry, you are purchasing "Honeyfund Wallet" gift card funds in the amount of your gift. Honeyfund Wallet gift card funds represent an obligation of Honeyfund and are redeemable via a page on Honeyfund.com website that serves the Amazon.com Gift Card redemption interface or the Incomm platform via APIs.
The gift recipient uses the funds to purchase the eGift Card you selected at the date of their choosing. The recipient may elect to retain your gift as stored funds in the amount you paid. They may use the stored funds to purchase other eGift Cards at Honeyfund. Unredeemed funds may be escheated in accordance with applicable state law.
eGift Cards available for sale via the Honeyfund Gift Card Shop or Honeyfund Registry include Partner gift cards Honeyfund makes available through partnership with Amazon.com Gift Card and Incomm.
The Claim Code or weblink, located in the eGift Card gift e-mail or text notification, is required to claim the partner’s eGift Card code.
There may be a delay from the time the eGift Card was purchased and the time partner eGift Card code may be claimed.
The partner eGift Card code can only be claimed via the Claim Code or weblink.
To check an eGift Card balance, follow the claim weblink, or contact Honeyfund customer service online. Balances are provided as available.
Partner eGift Cards are only redeemable per the merchant's terms of use for the full gift value. They may not be used for purchases from or adding funds to Honeyfund registries.
Partner eGift Cards can be issued and redeemed only in U.S. dollars ("USD").
Partner eGift Cards are not reloadable and do not expire. No service or inactivity fees apply.
Partner eGift Cards are not credit, debit or charge cards, and have no implied warranties.
Partner eGift Cards are not refundable and cannot be redeemed or exchanged for cash, check or credit except where refund or redemption is required by law.
When Partner eGift Cards codes are claimed, the process cannot be reversed or refunded.
Partner eGift Cards purchased outside of Honeyfund.com or a licensed partners are not valid or claimable at Honeyfund. Unauthorized sales of gift cards are subject to confiscation or voiding by Honeyfund.com, Inc.
Partner eGift Cards that are altered or obtained fraudulently are subject to confiscation or voiding by Honeyfund.com, Inc.
Honeyfund.com, Inc. is not responsible for Partner eGift Cards that are undeliverable or not received due to inaccurate delivery information provided by the purchaser.
Honeyfund.com, Inc. reserves the right to refuse, cancel or hold for review eGift Card purchases suspected for fraud, incorrect certificate or card denomination, or violations of these terms and conditions.
Honeyfund.com, Inc. may at any time and without notice change these terms and conditions or contract with a third party to administer the eGift Card program.
Use of Partner eGift Cards is subject to applicable law. In the event of a conflict between these terms and conditions and applicable law, applicable law will govern.
The laws of the State of Florida, without regard to its conflicts of law provisions, apply to these Terms and Conditions and use of any Honeyfund Gift Card Shop or Honeyfund Registry and Honeyfund Gift Card.
Honeyfund and its affiliates make no warranties, express or implied, with respect to Partner eGift Cards including any express or implied warranty of merchantability or fitness for a particular purpose.

3. The Honeyfund Gift Card

The Honeyfund Gift Card is a standalone product available for sale from 2016 to 2019 and is no longer available for sale. These terms govern any outstanding Honeyfund Gift Cards.
Honeyfund Gift Cards are issued by and represent an obligation of Honeyfund and are redeemable via a page on Honeyfund.com website that serves the Amazon.com Gift Card redemption interface or the Incomm platform via APIs.
The Honeyfund Gift Card may be redeemed for Partner gift cards Honeyfund makes available through partnership with Amazon.com Gift Card and Incomm.
The Honeyfund Gift Card Redemption Code or weblink, located in the Honeyfund Gift Card e-mail, is required for redemption.
The Honeyfund Gift Card may not be redeemed within two business days after the time of purchase.
The Honeyfund Gift Card can only be redeemed via the redemption link.
To check Honeyfund Gift Card balance, follow the redemption link, or contact Honeyfund customer service online.
Honeyfund Gift Cards purchased from honeyfund.com/giftcard may only be redeemed for the full gift value. They may not be used for purchases from or for adding funds to Honeyfund registries.
The Honeyfund Gift Card can be issued and redeemed only in U.S. dollars ("USD").
The Honeyfund Gift Cards are not reloadable and do not expire. No service or inactivity fees apply.
Honeyfund Gift Cards are not credit, debit or charge cards, and have no implied warranties.
Honeyfund Gift Cards are not refundable and cannot be redeemed or exchanged for cash, check or credit except where refund or redemption is required by law.
When the Honeyfund Gift Card is redeemed for a partner card, the Honeyfund Gift Card redemption cannot be reversed or refunded.
The Honeyfund Gift Card is only sold at Honeyfund.com or through licensed partners. Honeyfund Gift Cards for sale or sold by an unlicensed vendor are subject to confiscation or voiding by Honeyfund.com, Inc.
Honeyfund Gift Cards that are altered or obtained fraudulently are subject to confiscation or voiding by Honeyfund.com, Inc.
Honeyfund.com, Inc. is not responsible for Honeyfund Gift Cards that are undeliverable or not received due to inaccurate delivery information provided by the purchaser.
Honeyfund.com, Inc. reserves the right to refuse, cancel or hold for review transactions initiated using Gift Cards suspected for fraud, incorrect certificate or card denomination, or violations of these terms and conditions.
Honeyfund.com, Inc. may at any time and without notice change these terms and conditions or contract with a third party to administer the Honeyfund Gift Card program.
Use of the Honeyfund Gift Card is subject to applicable law. In the event of a conflict between these terms and conditions and applicable law, applicable law will govern.

4. Our Privacy Policies.

Purchases and redemption of eGift Cards via the Honeyfund website are subject to Honeyfund's Privacy Policy. Amazon.com Gift Cards are subject to Amazon.com’s Privacy Notice. Other Partner Gift Cards are subject to Incomm’s Privacy Policy. Honeyfund may provide Honeyfund Gift Card purchasers with information about the redemption status of the Gift Card.

5. Delivery Information and Requirements for Honeyfund Gift Card Purchasers.

All orders of Honeyfund Gift Cards and Partner eGift Cards are subject to a process that compares the purchaser's information provided to Honeyfund with information about the purchaser provided by the purchaser's financial institution. If there is a discrepancy, your Gift Card order may be delayed until it can be corrected. If the date on which you want the Gift Card delivered has passed and you have not received confirmation that the Gift Card was sent, please contact Honeyfund customer service online. Please refer to your order number or e-mail address. We are not responsible for Gift Cards that are undeliverable or not received due to your failure to enter an accurate e-mail address for the recipient. Please check to make sure the e-mail address of the recipient of the Gift Card is correct and contact Honeyfund customer service online if you suspect the recipient of the Gift Card did not receive his/her Gift Card. Should an e-mail be returned to Honeyfund due to inaccurate delivery information for the recipient, Honeyfund will attempt to contact you for a valid e-mail address.

6. Reasons for Failed Delivery of a Honeyfund Gift Card, Amazon.com Gift Card or Incomm Partner Card.

If you have confirmed the recipient's e-mail address but the Gift Card has not been viewed within a reasonable period after the requested delivery date, the following is a list of the most common reasons why delivery may have failed:

Spam filter blocked e-mail or routed it to a bulk/spam folder
Recipient's firewall blocked the e-mail
E-mail inbox is over size limit
Invalid e-mail address

If a spam filter is blocking help@honeyfund.com e-mails from getting to an inbox, your e-mail options will need to be modified so that help@honeyfund.com e-mails are not considered spam. If you need further assistance, contact Customer Support. Please refer to your order number or e-mail address.

7. Opt-in to future marketing campaigns or promotional offers.

You may have the option from time to time to opt-in to certain marketing campaigns or promotional offers from Honeyfund or its Partners.

8. Personalized Messaging.

If you wish to add a personal message when purchasing a Honeyfund Gift Card, simply type your message in the Message Field on the Gift Card preview. Personal messages are limited in length to the space provided on the Honeyfund Gift Card. There is no additional charge to include a personalized message. We may not read every message but if we find inappropriate, offensive or otherwise objectionable messages, we reserve the right to replace it.

9. Disclaimer.

The materials on the website are provided "as is" without warranties of any kind, either express or implied, including without limitation, warranties of title, implied warranties of merchantability, fitness for a particular purpose or non-infringement of intellectual property. We expressly disclaim any duty to update or revise the materials on the websites, although such materials may be modified at any time without notice. Your use of the website is at your sole risk and you assume full responsibility for any costs associated with your use of the website. We shall not be liable for any damages of any kind related to your use of the website.

10. Indemnification.

You agree to defend, indemnify and hold Honeyfund and Incomm harmless from and against any and all claims, damages, costs and expenses, including attorneys' fees, arising from or related to your use of the website and/or your breach of any representation, warranty, or other provision of the Agreement. If a Honeyfund Gift Card, Amazon.com Gift Card or Incomm Partner code is non-functional, your sole remedy against us and our sole liability shall be the full replacement of such Honeyfund Gift Card.

11. Disputes.

Mindful of the high cost of litigation, not only in dollars but also in time and energy, you and we agree to the following dispute resolution procedure: In the event of any controversy, claim, action or dispute arising out of or related to any transaction conducted on the website, a Honeyfund Gift Card, or the breach, enforcement, interpretation, or validity of this Agreement or any part of it ("Dispute"), the party asserting the Dispute shall first try in good faith to settle such Dispute by providing written notice to the other party(s) (by first class or registered mail) describing the facts and circumstances (including any relevant documentation) of the Dispute and allowing the receiving party 30 days in which to respond to or settle the Dispute. Notice shall be sent to: (1) Honeyfund.com, Inc. 2519 McMullen Booth Rd, Ste 510-260, Clearwater, FL 33761 Attn: Legal or (2) you at: your last-used billing address and/or the e-mail address in your online profile.

You and we agree that this dispute resolution procedure is a condition precedent which must be satisfied prior to initiating any litigation or filing any claim against the other party.

12. Choice of Law.

These Terms shall be construed in accordance with the laws of the State of Florida, without regard to any conflict of law provisions. You and we agree that any dispute arising under this Agreement shall be resolved exclusively by the state and/or federal courts of the State of Florida, County of Pinellas. The waiver of any provision of the Agreement shall not be considered a waiver of any other provision or of our right to require strict observance of each of the terms herein. If any provision of the Agreement is found to be unenforceable or invalid for any reason, that provision shall be severable, and all other provisions shall remain in full force and effect. This Agreement constitutes the entire agreement between us relating to your use of the website.
